San Diego Sleep and Sinus Clinic Patient Portal Terms and Conditions

NON-URGENT USE ONLY: It can take up to three business days for us to respond to you on the Patient Portal. If you have an emergency, dial 911. If you have an urgent medical matter regarding your care with us or if you want to communicate with us sooner, call us at (760) 942-9028.

ONLY OUR ACTUAL PATIENTS ARE ELIGIBLE: Only our patients are eligible to fill in health and personal information and correspond via the patient portal. Do not ask your spouse or anyone else to do it for you.

DOCTOR-PATIENT RELATIONSHIP: Communication with our office does NOT establish a doctor-patient relationship, which is only established when you are seen as a patient by the doctor in our office.

PASSWORD: Do not share your password with anyone. You are responsible for keeping your password confidential. If you fear it has been compromised or you forgot it, call us at (760) 942-9028 and we’ll give you a new one.

OTHER STUFF YOU CAN’T DO: Don’t upload private information belonging to anyone but you. Don’t use the Patient Portal to break any law, spam us, advertise anything, impersonate anyone or create any false records for you or anyone else. Don’t let anyone else use your account. Don’t post hateful, obscene, harassing, or abusive material or anything infringing on anyone else’s rights.

NO WARRANTY/DISCLAIMER: The Patient Portal and any information contained on it or provided through it are provided on an “As Is” basis. All access to and use of the Patient Portal is voluntary and at your sole risk. The Patient Portal is designed to be reliable and secure, but we don’t guarantee this. We make no warranty that access and information transferred through the Patient Portal will be uninterrupted, secure, or error-free.

INDEMNITY: You will indemnify us and our officers, directors and employees, against any damages, losses, liabilities, judgments, costs or expenses (including reasonable attorneys' fees and costs) arising out of a claim by a third party relating to your misuse of the Patient Portal or any violation of this Agreement by you.

LIMITATION OF LIABILITY: YOU EXPRESSLY UNDERSTAND AND AGREE THAT SAN DIEGO SLEEP AND SINUS CLINIC AND ALIYA S. FEROUZ MD MEDICAL CORPORATION SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR INJURY, ILLNESS, DISABILITY,DEATH, LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE PATIENT PORTAL; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PATIENT PORTAL; OR (iv) ANY OTHER MATTER RELATING TO THE PATIENT PORTAL.

TERM AND TERMINATION: This Agreement applies from the moment you first access the Patient Portal, (retro-actively if you have already done so) and all its terms last into perpetuity. You may terminate your Patient Portal account any time by written request to our office. We may terminate your access to the Patient Portal at any time with or without cause, without liability to you or any third party for any such termination. In such case, you will still be able to request copies of your medical records by contacting our office.

ADDITIONAL TERMS FROM THE PATIENT PORTAL VENDOR: Your use of the Patient Portal is subject to additional terms, incorporated herein, available at https://sdsleepclinic.etransmedia.com/terms.pdf or by request to us.

 

If you are a new patient and your first appointment is scheduled, you must click the RED BUTTON below to enter our patient portal and fill out your medical history before your scheduled appointment. Also, click on the blue buttons below to open the forms you will need to bring to your first appointment. Please print, fill out and bring in the forms.
